1.0 Agreement Scope & Western Australia Police Licensing
These Terms & Conditions constitute a legally binding agreement between WA Central Security (trading as WA Central Security Pty Ltd, ABN registered, hereinafter referred to as "WACS", "we", "us", or "our") and the party identified as the client ("Customer", "Client", or "you") named in any quotation, proposal, job sheet, or service agreement.
All security equipment supply, system design, physical installation, technical cabling, and monitoring services are performed under Western Australia Police Security Agent Licence #SA58248. Every consultant, technician, and installer deployed to your property holds a current, individual security licence issued under the Security and Related Activities (Control) Act 1996 (WA).
Statutory Security Agent Warranty: Under Western Australian law, only security installers individually vetted, fingerprinted, and licensed by the WA Police Force Licensing Services division may legally install, service, or maintain intruder alarms, access control systems, and CCTV equipment.
2.0 Quotations, Site Surveys & Variations
All formal written quotations provided by WACS are based on physical inspection, architectural drawings, or technical specifications supplied by the Client:
- Validity Period: Written quotations remain valid for 30 calendar days from the date of issuance, after which prices may be subject to review due to manufacturer supply chain fluctuations.
- Acceptance of Quote: A quotation is deemed accepted when the Client returns a signed proposal, confirms acceptance via email, pays the required deposit, or authorises commencement of works.
- Unforeseen Site Variations: Quotations assume standard timber or steel stud wall cavities and clear roof crawl spaces. If concealed obstacles (such as reinforced concrete, inaccessible ceiling cavities, asbestos, or unmapped underground utilities) are uncovered, WACS will notify the Client promptly and provide a transparent variation estimate before continuing.
3.0 Site Access, Utilities & Client Obligations
To enable efficient, safe, and professional execution of security works, the Client agrees to provide:
- Unhindered Site Access: Safe and continuous access to the premises during standard working hours (Monday to Friday, 7:00 AM – 5:00 PM) or agreed weekend/after-hours shifts.
- Continuous Mains Power: Dedicated 240V AC power points at designated equipment locations (NVR racks, alarm panel locations, and power supply units).
- Internet & Network Connectivity: For all systems requiring mobile app streaming (e.g. Dahua DMSS, Hik-Connect, Ajax Cloud) or IP remote monitoring, the Client is responsible for maintaining an active broadband connection with available router Ethernet ports.
- Third-Party Approvals: The Client warrants that all necessary landlord permissions, strata body corporate approvals, or local council development permits have been obtained prior to installation.
4.0 Payment Terms, Deposits & Invoicing
Our invoicing and payment schedules are structured transparently according to project scale:
- Residential Installations: A 50% deposit is payable upon quotation acceptance to secure installation scheduling and hardware allocation. The remaining 50% balance is strictly due upon practical completion and client handover on the day of installation.
- Commercial & Enterprise Accounts: Invoiced via milestone progress claims or standard 14-day commercial account terms subject to prior credit approval.
- Payment Methods: Direct Bank Transfer (EFT), Visa, and MasterCard. Credit card transactions do not attract surcharge fees.
- Default & Overdue Accounts: Accounts unpaid after the due date incur interest at the rate of 2.0% per month compounding. The Client agrees to indemnify WACS for all reasonable costs incurred in debt collection and legal enforcement.
5.0 Equipment Supply & Retention of Title (PPSA)
Risk of loss or damage to equipment passes to the Client immediately upon delivery to the designated premises. However, legal ownership and property title remain protected:
Retention of Title Notice (PPSA 2009): Ownership of and legal title in all security cameras, recorders, sensors, alarm panels, power supplies, brackets, and cabling supplied by WA Central Security shall NOT pass to the Client until all monies owing under the relevant invoice have been received in cleared funds.
- Security Interest: The Client acknowledges that these terms create a Purchase Money Security Interest (PMSI) under the Personal Property Securities Act 2009 (Cth) in all supplied goods.
- Right of Repossession: In the event of default, WACS and its authorised police-licensed agents may, after giving written notice, enter upon the premises where the goods are situated to decommission and repossess the unpaid equipment.
6.0 Warranties & Lifetime Workmanship Guarantee
We stand firmly behind our installations with dual-layer warranty protections:
- 3 to 5 Year Hardware Warranties: All commercial-grade CCTV cameras, NVRs, alarm control units, and access controllers are backed by genuine Australian manufacturer warranties ranging from 36 to 60 months (e.g. Dahua, Hikvision, Ajax Systems, Bosch, ICT Protege).
- Lifetime Workmanship Guarantee: WACS guarantees all physical cable runs, terminations, bracket fixings, conduit routing, and enclosure mountings executed by our technicians for the operating life of the installation while under original ownership.
6.1Warranty Exclusions
Warranty protection does not cover faults or damage arising from:
- Severe weather events, lightning strikes, grid power surges, water submersion, or Acts of God.
- Physical impact, vandalism, insect infestation, or rodent damage to exposed cabling.
- Unauthorised modifications, reprogramming, or third-party tampering without prior written authorisation from WACS.
- Internet Service Provider (ISP) network outages, router replacement, or forgotten client passwords.
7.0 24/7 Back-to-Base Alarm Monitoring Protocols
For clients using 24/7 back-to-base monitoring, services are delivered in partnership with an accredited ASIAL Grade A1 monitoring operations centre:
- Keyholder Response Order: Upon receiving an unverified alarm trigger, monitoring dispatchers contact client-nominated keyholders in strict sequential order.
- Mobile Security Patrol Dispatch: If keyholders are uncontactable or request physical inspection, a licensed mobile patrol unit is dispatched. Standard patrol call-out fees apply per attendance and will be invoiced to the Client.
- Western Australia Police Response Policy: The Western Australia Police Force (WAPOL) requires alarm verification (e.g. dual-zone trigger, visual camera verification, or keyholder on-site confirmation) prior to dispatching police personnel. WACS is not liable for police response priority or operational delays.
- Periodic System Testing: The Client is required to place their alarm in test mode and perform a routine sensor check at least once every 30 days.
8.0 Surveillance Devices Act 1998 (WA) Compliance
Following installation and system handover, the Client assumes full legal status as the operator and data controller of the surveillance equipment under Western Australian law.
Operator Legal Obligation: The Client warrants that surveillance cameras will not be repositioned or adjusted to capture private living spaces of adjacent neighbouring properties or areas where individuals have an expectation of privacy under the Surveillance Devices Act 1998 (WA).
WACS supplies certified statutory CCTV warning signs upon request. Displaying warning signage at property entry perimeters remains the customer's ongoing legal responsibility.
9.0 Australian Consumer Law (ACL) & Limitation of Liability
Our goods and services come with guarantees that cannot be excluded under Schedule 2 of the Competition and Consumer Act 2010 (Australian Consumer Law). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
To the maximum extent permitted by Australian law, the total liability of WACS for any claim arising out of equipment failure or service provision is limited to:
- The replacement or repair of the defective security equipment; or
- The resupply of the installation service, or payment of the reasonable cost of having the service resupplied.
Security Disclaimer & Insurance Advice: While electronic security systems, alarms, and CCTV cameras provide a powerful visual deterrent and early warning system, they cannot guarantee total immunity against unlawful intrusion, burglary, or fire. WACS is not an insurer; clients must maintain adequate building and contents insurance policies at all times.
10.0 Cancellations, Delays & Termination
- Client Cancellation: If a client cancels an agreed installation after procurement of customised equipment, a restocking fee of up to 20% of hardware value may apply to offset supplier handling and return costs.
- Force Majeure: WACS shall not be liable for installation delays caused by industrial disputes, component import embargos, state emergency declarations, or severe weather conditions.
- Monitoring Agreement Termination: Recurring monitoring contracts may be cancelled by either party upon providing 30 calendar days' written notice, subject to any minimum fixed-term contract agreed in the initial order.
11.0 Governing Law, Jurisdiction & Official Notices
These Terms & Conditions are governed by and construed in accordance with the laws of Western Australia, Australia. The parties submit to the exclusive jurisdiction of the Courts of Western Australia and the Federal Court of Australia.
If any provision of these terms is deemed invalid or unenforceable, such provision shall be severed without affecting the validity and enforceability of the remaining provisions.
